Starter terms. This is a plain-English Terms of Service drafted by the founders for the Phase 1 closed beta. It is not legal advice and will be reviewed by a Canadian lawyer before our public launch. Email [email protected] with any questions or concerns.

Welcome to Hesed.love. These Terms ("Terms") govern your access to and use of the Hesed.love coaching application and related services (collectively, the "Service") operated by Ayodeji Samuels and Lizzy Samuels, sole proprietors, doing business as Hesed.love, based in Calgary, Alberta, Canada ("Hesed.love," "we," "us," or "our").

By creating an account, signing in, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Hesed.love provides a faith-default coaching application for parents and their children. The Service uses artificial intelligence (specifically the Claude family of models provided by Anthropic) to generate coaching content, and uses voice-cloning technology (provided by ElevenLabs) to optionally render audio in a parent's recorded voice. The Service is not a substitute for professional advice from a doctor, therapist, financial advisor, lawyer, or religious leader.

2. Eligibility & account creation

To create an account in your own name, you must be at least 18 years old and have the legal capacity to enter into a binding agreement.

Children may use the Service with verifiable parental or legal-guardian consent, subject to the age tiers and protections described on our Minors Safety page. The parent or guardian is the contracting party and is responsible for the child's use of the Service.

You agree to provide accurate, current, and complete information when creating your account and to keep that information up to date. You are responsible for maintaining the confidentiality of your magic-link sign-in code and for all activity that occurs under your account.

3. Subscription, billing & renewal

Some features of the Service require a paid subscription. Current plans and pricing are listed on our Pricing page. Prices are stated in Canadian dollars (CAD); your local currency may be converted at checkout by our payment processor (Stripe).

Paid subscriptions renew automatically at the end of each billing period (monthly or annual) at the then-current price until you cancel. Before any price increase, we will give you at least 30 days' written notice to the email associated with your account; you may cancel before the new price takes effect.

Sales taxes, GST, HST, VAT, or other applicable taxes are added at checkout where required by law.

4. Cancellation & refunds

You may cancel your subscription at any time from your account Settings. Cancellation takes effect at the end of the period you have already paid for; you retain access until then. We do not refund partial billing periods. Full details on our Refunds & Cancellation page.

5. Acceptable use

You agree to use the Service in line with its purpose — coaching, formation, and family-building under covenant grace. You will not, and will not permit any other user (including a child on your Family plan) to:

You retain ownership of the content you submit to the Service — your journal entries, your goals, your coach conversations, the voice recording you upload to create a voice clone, the report cards and school documents you upload. We do not claim ownership of any of it.

By using the Service, you grant Hesed.love a limited, non-exclusive, worldwide, royalty-free license to process your content solely as required to deliver the Service to you — for example, to forward a coaching prompt to Anthropic's API, to generate audio via ElevenLabs, to display your tracker, or to back up your data.

We do not use your content to train AI models. We do not sell, rent, or share your content with third parties for advertising or marketing.

7. AI-generated content disclosure

Coach responses are generated by an AI model (Claude, provided by Anthropic). They are not produced by a human. They may contain errors, omissions, or content that is not appropriate for your situation. You are responsible for evaluating Coach responses before acting on them. The Service does not provide medical, legal, financial, or other professional advice.

Audio rendered in a parent's voice via the voice-cloning feature is also AI-generated. It is intended for delivery to family members; it must not be used to impersonate anyone in a public or commercial context.

8. Third-party services

The Service relies on third-party providers, including Anthropic (AI model), ElevenLabs (voice cloning), Resend (email), Stripe (payments), and Cloudflare (hosting, DNS, and email routing). Your use of the Service is subject to those providers' own terms and policies. We are not responsible for the actions of these providers.

9. Privacy

Our handling of your information is described in our Privacy Policy, which is incorporated into these Terms by reference. In short: we do not store the contents of your coaching messages; we collect only the minimum metadata required to bill and operate the Service.

10. Intellectual property

The Service — its design, code, copy, brand, audio, illustrations, and documentation — is owned by Hesed.love and is protected by Canadian and international copyright, trademark, and other intellectual-property laws. We grant you a personal, non-transferable, revocable license to use the Service for personal and family purposes only.

The Hesed.love name and logo are trademarks of Hesed.love. You may not use them in commerce without our written permission.

11. Termination

You may stop using and terminate your account at any time. We may suspend or terminate your account if you materially breach these Terms — for example, by violating the Acceptable Use section, creating accounts for children outside the consent process, or attempting to evade content-safety controls. Where we can give you advance notice and an opportunity to cure, we will. In serious cases (illegal use, child safety violations) we may terminate immediately.

12. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or suitable for any particular use.

13. Limitation of liability

To the maximum extent permitted by law, Hesed.love and its founders will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability for any claim arising out of or relating to the Service is limited to the amount you have paid us in the twelve months immediately preceding the claim.

Nothing in these Terms limits liability that cannot be limited under applicable law — including liability for fraud, gross negligence, or wilful misconduct.

14. Indemnification

You agree to indemnify and hold harmless Hesed.love and its founders from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your breach of these Terms, your violation of any law, or your infringement of any third party's rights.

15. Governing law & disputes

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in Alberta, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms will be brought exclusively in the courts of Calgary, Alberta, and you consent to that jurisdiction.

If you are a consumer in the EU, UK, or another jurisdiction that grants you mandatory rights to bring claims in your local courts, nothing in this section limits those rights.

16. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will give you at least 30 days' notice by email to the address associated with your account and by posting the updated Terms here, with a new "Last updated" date. Your continued use of the Service after the effective date constitutes acceptance.
